In Re Cecil Davis, WSSC #89590-2

On September 12, 2017 WACDL filed an amicus brief in support of a motion for reconsideration of the opinion issued May 18, 2017. In that opinion the WSSC upheld the imposition of the death death penalty which had been challenged on the basis that Washington's death penalty system unconstitutionally fails to protect a defendant with intellectual disabilities from execution.

WACDL Amicus

Whether the right to counsel for a capital defendant in a state post-conviction PRP requires appointment of capital qualified counsel with prior experience and training in PRP's. WSSC has established qualification requirements for attorneys representing death penalty cases on a PRP in RAP 16.25 and in this case the PRP attorney did not satisfy those requirements.
